This is an application wherein petitioner has prayed for expeditious disposal of the proceeding being G.R. Case no. 152 of 2022 presently pending before learned Chief Judicial Magistrate, 1st Court, Basirhat.

It is submitted by the petitioner that the investigation of the case started on 10th January, 2022 and the charge-sheet submitted on 31st May, 2022. Thereafter the charge was framed on 9th January, 2024 and next date for adducing evidence was fixed on 21 January, 2025. However, on that day no witness was present and, as such, the Court fixed next date 13 months thereafter i.e., on 01.04.2026.

He further submits that from the list of dates it is clear that the Trial Court is fixing the date once in a year and thereby the trial is lingering for a considerable period of time. Accordingly, he prayed for a direction upon the Court below for expeditious disposal of the abovementioned criminal proceeding. Since the prayer made by the petitioner is innocuous and if any order is passed in terms of the prayer made by the petitioner, the opposite party will have no cause to prejudice, the service of

the copy of the application upon the opposite party is hereby dispensed with.

Having considered the submission made on behalf of the petitioner and going through the materials available in the record, I find that the prayer made by the petitioner is justified and required to be allowed for the ends of justice.

In view of the above, CRR 3513 of 2025 is hereby disposed of with the direction upon the Court below to make every endeavour for expeditious disposal of the instant proceeding and if possible by conducting day to day trial and he will made his best endeavour to conclude the trial preferably within a period of six months from the next date fixed for hearing. This order is passed invoking this Court's jurisdiction under Section 529 of BNSS.
