Ms. Sukanya Bhattacharya Sufi Kamal ... For the State Learned counsel for the petitioner submits that the petitioner is in custody for more than 200 days and prays for bail. Co-accused Sk. Yasin @ Yeasin who is similarly circumstanced with the petitioner has been granted bail by the Court.

Learned counsel for the State opposes the prayer. The petitioner is one of the principal assailants who dealt the fatal blow on the victim. He does not appear to be similarly circumstanced with the co-accused on bail. In fact, the role of the petitioner and one Abdul Khalek whose bail prayer has been turned down by this Court appears to be similar.

Considering the material on record and prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.

The application for bail is disposed of.
