Petitioner is directed to serve a copy of the revisional application upon Mr. Imran Ali, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Mr. Chatterjee, learned advocate for the petitioner submits that the petitioner is in custody for more than 13 months and after the chargesheet has been submitted, the learned trial court has fixed date for consideration of charges in the month of October, 2023.

Learned advocate contends that there are 10 witnesses on whom the prosecution intends to rely and as such the custodial trial/detention would be prolonged.

In view of the submissions so advanced, I am of the view that the anxiety of the petitioner is justified. Accordingly, the learned special court is directed to see that the charges are framed in the month of October, 2023, the next date so fixed or within a

fortnight thereafter.

On and from November, 2023, the learned trial court would fix dates by way of a schedule consisting of three dates and fix a schedule once in every 60 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. The learned trial court would pass necessary directions upon the concerned Superintendent of Police. In case any witness who belong to the government department is reluctant to appear before the court, the Superintendent of Police on such directions/order would ensure the presence of the witnesses who belong to the government department. The Public Prosecutor conducting the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned.

All efforts be taken by the stake-holders to cooperate with the trial court so that the trial is concluded at the earliest possible time. With the aforesaid observations, the present revisional application being CRR 2887 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
