There are typographical errors in the order dated August 12, 2024.

In the said order, the words 'the petitioner is' appearing in the first line of the fourth paragraph of it, be deleted and be replaced with the words 'the opposite parties are'. Other portions of the said order shall remain unaltered.

The Department is directed to carry out the aforementioned correction in the said order to the extent as indicated above, similar correction be also carried out in the certified copies of the order, if already supplied to the parties, upon production of the same.

Mr. Jayanta Samanta, the Special Officer appointed in this matter, files his report, let it be kept with the record.

It appears from the report that the necessary repair works of the suit room has already been executed.

Ganguly, learned Advocate for the petitioners though alleges that the opposite parties have encroached upon new areas but Mr. Samanta submits that there is no such encroachment, only the extended tile shed behind the suit shop room has been covered by black polythene, be that as it may, if there is any such encroachment, the petitioners are at liberty to take appropriate steps for removal of such encroachment in accordance with law.

In view of the completion of the repair work of the suit shop room, the Commission work as directed by the part of the order impugned, is not necessary. Mr. Samanta is discharged from his duty.

The learned Trial Judge, however is requested to dispose of the pending application under Order XIV Rule 2 of the Code of Civil Procedure as expeditiously as possible in accordance with law and in doing so, shall not grant any unnecessary adjournment to either of the parties.

C.O. 2736 of 2024 is disposed of with the above terms without any order as to costs.

Photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
