Learned advocate for the petitioner submits that the petitioner is in custody for more than 2 years and the trial has not been progressed although the charge was framed on 8th October, 2021.

It has been brought to the notice of this court that the next date is fixed for consideration of evidence on 16th February, 2022.

In view of the prayers advanced by the learned advocate for the petitioner, Mr. Bidyut Kumar Roy, learned advocate who ordinarily appears for the State is directed to appear in this matter. His appointment may be regularized in due course.

Having regard to the submissions so advanced, I am of the opinion that a direction is required for the learned special court to expedite the progress of the trial.

In view of the majority of the witnesses belonging to the Govt. Department /Police Department, I direct that learned trial court on and from 6th February, 2022 would fix at least a schedule of three dates in every forty five days and take the trial to its logical conclusion within a reasonable period of time.

It is further directed that unnecessary adjournments should not be granted to either of the parties and a date for examination of the witness would be fixed after the learned Public Prosecutor appearing in the trial court assures the court regarding the availability of the witnesses. Examination of the prosecution witnesses must be completed by December, 2022.

With the aforesaid observations, the revisional application being CRR 2458 of 2021 is disposed of. Connected applications, if any, are consequently disposed of.
