2023-08-22Hon'Ble Justice Tirthankar Ghosh2 pages

22.08.2023 Serial no. 4 [G.S.D] CRR 3074 of 2022 In the matter of : Md. Nadeem ... ... Petitioner The revisional application was preferred by the petitioner challenging the order passed by the Learned Judicial Magistrate, 1st Class, 2nd Court, Sealdah, thereby awarding maintenance of Rs.8,000/- to the wife and Rs.5,000/- to each of the minor children aggregating a sum of Rs.18,000/- per month.

The Learned Court after assessing the capacity of the present petitioner, who is a businessman having business of card board/sweet box/shoe box and other related boxes, by which he can earn Rs.90,000/- per month, decided the award to the tune of Rs.18,000/- per month (aggregate) as maintenance.

Having regard to the reasons so assigned by the Learned Magistrate/the Trial Court, I am of the opinion that the grounds so assigned by the Learned Trial Court do not call for any interference.

Accordingly, CRR 3074 of 2022 is disposed of. Pending application, if any, is also disposed of.
