07.08.2024 Sl No.36 Court No.29 TN CRM (A) 2703 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973, corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Ranaghat Women Police Station Case No.28 of 2024 dated 16.03.2024 under Sections 341/323/326/506/34 of the Indian Penal Code.
And In the matter of : Lakshmi Biswas .... petitioner Ms. Meenal Sinha ....for the petitioner Mr. Ashok Das ... for the State 1.
The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated. 2.
The learned counsel for the State submits that the de facto complainant has alleged use of abusive language by the petitioner towards his mother and since he protested he was physically assaulted by the petitioner.

The case diary is produced. From the injury report it appears that there is soft tissue swelling and fracture noted at the distal radius and styloid process of ulna.

Considering the statement of the injured and the nature of the injury suffered by the de facto complainant which resulted in fracture a noted above, we are not inclined to grant anticipatory bail to the petitioner.

Accordingly, this application for anticipatory bail is rejected. (Soumen Sen, J.) (Uday Kumar, J.)
