AD 32 September 17, 2025 Ct. 28 SG CRM(A) 2887 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Uluberia P.S. Case No.700 of 2014 dated 18.09.2014 under Sections 399/402 of the IPC.

Learned counsel for the petitioner submits that the principal co-accused in this case was granted bail. The petitioner has been falsely implicated in this case. Learned counsel for the State opposes the prayer for anticipatory bail and submits that the petitioner had falsely averred in the application that he did not move any anticipatory bail application before the Sessions Court or before this Court. The petitioner has moved several applications before the Sessions Court which were rejected. He also moved an application before this Court, which was rejected on 25.03.2019.

Considering the serious nature of allegations, the fact that the petitioner did not submit to the jurisdiction of the court despite knowledge of the fact that the FIR was

registered in 2014, at least by 18.10.2024 when the petitioner's application for anticipatory bail was turned down by the Sessions Court and the fact that there was nondisclosure and misrepresentation of facts made in the application for anticipatory bail, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected Considering the deliberate misrepresentation made in this application, the petitioner shall pay a cost of Rs.20,000/- within a fortnight from this date to the State Legal Services Authority. Receipt of the same shall be deposited before the learned Registrar General within a week thereafter.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
