The petitioner claims transfer on medical ground of his mother and wife. He also has a daughter of two years of age. He is currently posted in Purulia and his permanent residence is in Hooghly. It has been submitted that the disease from which his mother is suffering a very rare disease and the petitioner is required to take care of his ailing mother because his wife is also suffering from medical ailments. An application seeking transfer is pending consideration at the end of the West Bengal Board of Primary Education.

Without going into the merits of the application for transfer, the instant writ petition is disposed of by directing the Secretary, West Bengal Board of Primary Education to take a decision on the application for transfer made by the petitioner in accordance with law and upon verification of the documents filed in support of the said application.

Steps shall be taken at the earliest, but positively within a period of 90 days from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

Learned advocate for the petitioner is directed to forward a copy of the application seeking transfer along with all documents in support of his prayer to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
