It is an admitted position that part payment amounting to Rs.36,00,000/- has already been made. There is no dispute with regard to the outstanding dues payable to the petitioner. The Executive Engineer, PWD, Howrah Electrical Division, has admitted that the balance of the demand would be paid once the money was received from the competent authority.

Under such circumstances, the competent authority shall release the amount in favour of the Executive Engineer, PWD, Howrah Electrical Division, immediately not later than November 15, 2024 and the Executive Engineer, PWD, shall

make the onward payment to the petitioner within two weeks thereafter.

The order shall be treated as mandatory, as there is no denial by the authorities with regard to the claim of the petitioner.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

All parties are to act on the basis of the server copy of this order.
