Application has been made by the petitioner for sanction of lifetime family pension before the District Inspector of Schools (Primary Education) on 7th October, 2021.

The grievance of the petitioner is that the same has not been considered till date.

As it appears that the prayer of the petitioner is pending consideration at the end of the District Inspector of Schools (Primary Education), Birbhum accordingly, the instant writ petition is disposed of by directing the respondent No. 6 to consider and dispose of the representation filed by the petitioner praying for family pension, strictly in accordance with law, at the earliest, but positively within a period of ten weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

If the said respondent is of the opinion that the petitioner will be entitled to receive family pension, then necessary consequential order(s) shall be passed by the said authority.

The petitioner is directed to forward a copy of the representation dated 7th October, 2021 along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court. The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
