It is submitted by the Learned Advocate for the petitioner that the petitioner does not want to press the instant application and the application may be dismissed being not pressed.

However, it is found from the report submitted by the Learned Judicial Magistrate, 2nd Court at Ranaghat duly forwarded by the Learned Sessions Judge, Naida that the petitioner obtained the order of bail on material suppression of the fact that similar application for bail was pending for consideration before this Court on the date on which the Learned Judicial Magistrate granted her bail. As the order of bail was obtained by the petitioner on material suppression of the fact, the said order is cancelled. The petitioner is directed to surrender before the Court below within a fortnight and file an application for bail afresh and the Learned Magistrate shall consider the same in accordance with law.

The instant application under Section 439 of the Code of Criminal Procedure is dismissed for being not pressed. ( Bibek Chaudhuri, J. )
