Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Ms. Amita Gaur, learned advocate, who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner submits that the petitioner is in custody since 03.06.2022 and till date, charge has not been framed although charge-sheet has been submitted.

Learned advocate submits that the prosecution has relied upon 17 witnesses to prove its case out of which 11 witnesses belong to the government department and six of the witnesses are independent witnesses. The next date, as has been informed, is fixed on 16.08.2023.

The learned trial court/special court is directed that steps be taken so that charges are framed on 16.08.2023 or within a fortnight thereafter. The learned trial court thereafter would take efforts for commencing the trial in the second week of October 2023. The learned trial court would be at liberty to fix schedule consisting of three dates and fix such a schedule once in every three months so that trial of the case

can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties.

The learned trial court would communicate with the Superintendent of Police of the concerned district who is bound to maintain a register so that witnesses who are to appear before the court on the dates so fixed by the learned trial court should not be absent.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

All stakeholders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the revisional application being CRR 2893 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
