The petitioners claim themselves to be the trustees of Anath Bandhu Angurbala Social Welfare Trust. The trust runs a B. Ed. College namely, Anath Bandhu Angurbala Teachers' Training Institute at Purba Medinipur.

It is the grievance of the petitioners that the private respondents, in violation of the terms of the original trust deed, have taken control over the college and they are siphoning the funds of the college. It appears that the petitioners made a representation before the National Council for Teacher Education alleging misappropriation of fund.

In course of hearing learned advocate for the university, respondent no. 2, has made over a letter dated January 14, 2022 whereby the National Council for Teacher Education communicated to the Principal of the said college as follows:

"The Committee noted a complaint received against the institution regarding dispute between the members of management and related fraudulent activities, which does not come under the domain of NCTE. Hence, no action required on the part of ERC NCTE. The institution is required to resolve the same on their own from the concerned State Govt.

Authority under which the society/trust of the institution has been registered."

It is also the grievance of the petitioners that the college name has been changed by NCTE behind back of the petitioners from "Anath Bandhu Angurbala Teachers' Training Institute"to "Gandhari College". In this writ petition, the petitioners have not challenged the said order dated April 05, 2022 whereby the name of the institution has been changed by the National Council for Teacher Education.

I find no ground to interfere with the communication dated January 14, 2022.

However, I make it clear that the petitioners will be at liberty to challenge the order dated April 05, 2022 changing the name of the institution, in accordance with law.

Accordingly, WPA 18589 of 2023 is dismissed.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with the requisite formalities.
