The petitioner is in custody for about six months and prays for bail.
Learned counsel for the petitioner submits that out of 22 accused persons sixteen have been granted anticipatory bail, three have been granted bail and two of the accused are still absconding. Further detention of the petitioner is not required. Learned counsels for the State and the defacto complainant oppose the prayer.
I have considered the material on record.
The eye witnesses have named the petitioner as the principal assailant who assaulted the victim with a brick on his head resulting in his death. The postmortem report supports the prosecution case.
Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The application for bail is disposed of.
