Learned advocate appearing for the petitioner submits that the subject matter of the case involves 648 bottles of Fairdyl and Phensedyl Cough Syrup.

Petitioner's name transpired on the basis of statement of co-accused and no recovery has been made from him. There is no possibility of the trial commencing and as such petitioner prays for bail on any stringent condition as the petitioner is in custody for 199 days.

Learned advocate for the State opposes the prayer for bail.

I have considered the materials appearing in the case diary and I am of the view that further detention of the petitioner is unwarranted in the facts of the present case. Accordingly, petitioner, namely, Rajjak Ali Sarkar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge under NDPS Act cum Additional Sessions Judge, 3rd Court, Dakshin Dinajpur.

If on bail the petitioner shall be physically present on each and every date fixed by the learned Trial Court and also not leave the jurisdiction of the District of Dakshin Dinajpur without the permission of the learned Special Court. Accordingly, CRM (NDPS) 1009 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
