Learned advocate for the petitioner submits that his client is not getting the family pension, whose husband was a Primary School Teacher, retired on 31.10.2021 and expired on February, 2022.

Learned advocate for the State has submitted that the said teacher has a shortfall of service of nine months or so. Therefore, I direct the Secretary, School Education Department to give an opportunity of hearing to the petitioner or her authorised representative for a hearing within a period of three months from the date of communication of this order to look into the matter under the Death-cum-Retirement Benefit Scheme, 1981 to see whether the shortfall of service of the Primary School Teacher can be condoned. With this observation and direction, this application is disposed of. The petitioner is directed to

communicate this order to the Secretary, School Education Department, Government of West Bengal immediately. There shall, however, be no order as to costs. (Abhijit Gangopadhyay, J.)
