Learned Counsel appearing on behalf of both the parties submit that the parties have amicably settled their dispute out of Court and they have mentioned their terms of settlement in paragraph 11 of the application, being IA No. CAN 2 of 2024. Accordingly, parties have arrived at an amicable settlement and they have sought for disposal of this appeal in terms of settlement as described in paragraph 11 of the application.
On perusal of the terms of settlement I find nothing illegal in the terms of settlement and as such the prayer is allowed.
Let Second Appeal, being S.A. 331 of 2010 be decreed in final form in terms of paragraph 11 of the application, being IA No. CAN 2 of 2024.
Let the terms of settlement as mentioned in paragraph 11 of the application be made part of the decree. Second Appeal, being S.A. 331 of 2010 along with the connected application, being IA No. CAN 2 of 2024 are
disposed of.
Let the Court records which were called for be sent down to the Courts below at once.
