Re: CAN 1 of 2019 (Old No. CAN 726 of 2019) This is an application for recalling of the order dated 10th January 2019 passed by one of the Division Bench of this Court.

Upon perusing the averments made in the application and after hearing the submissions advanced by the learned Advocate for the petitioner, we are satisfied that the petitioner was prevented by sufficient cause in not appearing on 10th January 2019, when the writ petition was dismissed for default.

The application for restoration being CAN 1 of 2019 (Old No. CAN 726 of 2019) is allowed. The writ petition is restored to its original file and number.

Let the writ petition be listed one week after reopening of this Court following Puja Vacation for the year 2022 for hearing.
