The petitioners seek parity with the co-accused who have been granted bail earlier.

Learned counsel for the State does not oppose the said fact. This Court is informed that the petitioners absconded for about two years. The co-accused who have been granted bail earlier were also absconding for more than a year.

In view of the fact that the petitioners are similarly circumstanced with the co-accused who have been granted bail by the Court earlier, they deserve the same benefit. Accordingly, prayer for bail is allowed.

The petitioners namely Joydeb Mondal @ Jaydeb Mondal and Sahadeb Mondal be released on bail upon furnishing bond of Rs.10,000/- (Rupees ten thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad, subject to the condition that they shall remain within the jurisdiction of Raninagar Police Station till completion of trial

and shall appear before the learned trial Court on every date of hearing. They shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event the petitioners fail to adhere to any of the conditions stated hereinabove without justifiable cause, the learned trial Court shall be at liberty to cancel their bail in accordance with law without further reference to this Court.

The application for bail is disposed of.
