The petitioner is challenging the recruitment process initiated by the Government of West Bengal Health Recruitment Board inviting online application from eligible candidates for recruitment of staff nurse, Group - II under Health and Family Welfare Department, Government of West Bengal. The recruitment process admittedly relates to a civil post under the State. In view of the provisions of Section 15(1((a) read with Section 3(q) and 28 of the Administrative Tribunals Act, 1985 this Court lacks the jurisdiction to receive, try and determine the writ petition.

The writ petition is, accordingly, dismissed as withdrawn with liberty to file afresh on the selfsame cause if otherwise permissible in law.

The time spent between 26.07.2024 and today, i.e. 07.10.2024 shall be construed as time spent in

prosecuting a litigation in a bona fide manner before a Court without jurisdiction.
