Petitioner approached this court being aggrieved by the progress of Joypur Police Station Case No. 121 of 2024 dated 15.07.2024.

The grievance of the petitioner was at that stage that, the police authorities were not acting and/or effectively investigating the case.

To that effect, State was directed to produce the case diary.

Mr. Bandopadhyay, learned Senior Standing Counsel has produced the case diary and submitted that in the meantime trial has progressed and only 5(five) witnesses are left to be examined.

I have considered the statement of the witnesses, the post-mortem report as well the FSL

Report, overall appreciation of the same and considering the stage at which the trial is presently pending, I do not find that there is any scope for interference at this stage. Further I find that investigation of this case was carried out with efforts and on the basis of the statement of the witnesses. Materials were collected as also opinion of the scientific expert sought for.

It would be now for the trial court to arrive at a final conclusion in respect of the case.

At this stage there is no scope for interference.

As it has been informed by the State that only 5(five) witnesses have been left, learned Trial Court would ensure that the trial be completed at the earliest.

With the aforesaid observations WPA 19188 of 2024 is disposed of.
