Learned advocate appearing for the petitioner undertakes that he is ready and willing to clear dues and arrears which have accrued in M.Ex. 97 of 2019 which is pending before the learned ACJM, Kakdwip, South 24 Parganas.

Learned advocate submits that he requires a month's time to clear dues which have accrued. If by 11th September, 2023 the arrears are cleared, the learned ACJM, Kakdwip, South 24 Parganas would recall the warrant of arrest so issued.

I find from the records that on 18th August, 2023 there is already a date fixed before the learned court. If the petitioner deposits 50% of the arrears, in that case, on 18th August, 2023, the learned ACJM, Kakdwip, South 24 Parganas would stay the execution of warrant of arrest till 11th September, 2023. With the aforesaid observations, CRR 2897 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly
