Chatterjee ...for the Petitioner The petitioner is represented by Mr. Sounak Ghosh, learned advocate and he specifically moves the revisional application and prays for expeditious disposal of Application under Order 39 Rule 4 Civil Procedure Code filed by it on 12th March, 2019 in Misc. Appeal No. 234 of 2018 pending before the Additional District Judge, 10th Court at Alipore, South 24 Parganas.

By filing the present revisional application under Article 227 of the Constitution of India, the petitioner has prayed for expeditious disposal of an interlocutory application under Order 39 Rule 4 read with Section 151 of the Code of Civil Procedure, which is pending for more than 2 years.

Considering such facts, the learned Additional District Judge, 10th Court at Alipore, South 24 Parganas is requested to dispose of interlocutory application under Order 39 Rule 4 Civil Procedure

Code pending in Miscellaneous Appeal No. 234 of 2018, as expeditiously as possible and in any event, within one month from the date of communication of this order, without granting any unnecessary adjournment to the either of the parties.

Since the petitioner has prayed for expeditious disposal of pending application under Order 39 Rule 4 Civil Procedure Code in Miscellaneous Appeal No. 234 of 2018, this court does not find any need to serve copy of the notice to the other side at it is not likely to cause any prejudice to the other side. Therefore, service of notice on the other side is dispensed with.

Accordingly, the revisional application being C.O. 2128 of 2021 is disposed of.

Interim order, if any, granted earlier stands vacated.

There shall be no order as to costs.
