Mr. Somnath Ganguli, ld. AGP Mr. Bikash Goswami ... for the State-Respondent(s) The petitioner approached this court with a prayer for restraining the respondent nos. 6 to 8 from breaking the boundary wall of the property till disposal of the title suit being TS 221 of 2023.

The records of the writ petition reflect that the said title suit is pending between the parties.

Learned advocate for the State has submitted a report which reflects that the said title suit being TS 221 of 2023 is pending before the learned Civil Judge (Jr.Divn.), 2nd Court, Purba Bardhaman and the police authorities, at the relevant point of time, have drawn up a proceeding

under Sections 126/135 of the BNSS. The report also reflects that the dispute relates to an ancestral property.

Having considered that the learned civil court is already in seisin of the issues, I am of the view that the petitioner would better be advised to approach the jurisdictional civil court in case there is breach of any directions passed by the said civil court.

If the petitioner is faced with fresh inconveniences, he would file a fresh representation to the Inspector-in-charge of Burdwan police station who would assess and ascertain in respect of the allegations and act in accordance with law.

With the aforesaid observations, WPA 19340 of 2024 is disposed of.

Pending application(s), if any, is also disposed of.
