Tuni Bibi v. State Of West Bengal And ORS.
D/L 21 13.08.2025 ct.no.35 Kausik W.P.A. 18409 of 2025 Tuni Bibi
Versus
State of West Bengal & Ors.
Mr. Pintu Karar Mr. Sabab Uddin Laskar ...for the Petitioner.
Mr. Kishore Datta, Ld. A.G.
Mr. Swapan Banerjee Ms. Sumita Shaw Mr. Soumen Chatterjee ...for the State.
Petitioner is aggrieved in respect of the progress of investigation of Gurguripal PS Case No. 91/25. Police authorities have submitted a report before this Court. Report includes the post-mortem report as well as a requisition which has been sent to the FSL. Seizures have been effected, statement of the witnesses have been recorded.
I have, prima facie, applied my mind to the post-mortem report and is of the view that the police authorities are taking steps in accordance with law. The offence allegedly was committed on or about 10.07.2025.
Having regard to the fact that the investigation of the case is in progress, at this stage, before the FSL report is received by the Investigating
Officer, I am of the opinion that no interference is called for.
The case commenced on 10.07.2025, as such the Investigating Officer would submit a progress report if he is unable to submit the charge sheet within the scheduled time, after 90 days from 10.07.2025 to the defacto complainant. If the defacto complainant/petitioner is aggrieved on consideration of the progress report, he would be at liberty to approach this Court for addressing grievances which may be surfaced on the progress report submitted by the Investigating Officer itself.
With the aforesaid observations WPA 18409 of 2025 is disposed of.
Report submitted be kept with the record.
Copy of the report be handed over to the learned advocate appearing for the petitioner.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
