Chintamoni Mal v. State Of West Bengal
16.09.2025 Item No.14 Ct.No.34 rc.
Reject C.R.M. (M) 1367 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Patashpur Police Station Case No. 375 of 2023 dated 07.08.2023.
And In Re :
Chintamoni Mal ... Petitioner Mr. Mazhar Hossain Chowdhury Ms. Chandrima Debnath ... for the Petitioner Mr. Aniket Mitra Mrs. Suruchi Saha ... for the State Mr. Dhruv Surana ...for the defacto complainant Heard learned counsels for the parties.
The petitioner is in custody for 240 days and prays for bail.
Learned counsel for the State opposes the prayer. I have considered the material on record. The victim lodged complaint against the petitioner and the co-accused. After being granted bail in the said case, the petitioner along with other co-accused entered the house of the victim and jointly assaulted him severely. The victim succumbed to his injuries. All the eye witnesses have implicated the petitioner in the alleged offence. Charges have been framed. Witness action has commenced.
Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The bail application is disposed of.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
