The present revisional application has been preferred in respect of M. Case No.571 of 2021 under Section 125 of the Code of Criminal Procedure which is pending before the learned Judicial Magistrate, 1st Court, Barasat, North 24-Parganas. It has been informed that the next date has been fixed on 16th January, 2024.

Having regard to the purpose for which the legislature incorporated the provisions of Section 125 of the Code of Criminal Procedure and the delay which has occasioned in the present case, I direct the learned Judicial Magistrate, 1st Court, Barasat, North 24 Parganas to dispose of the application for interim maintenance on the next date so fixed, i.e. 16th January, 2024 or within a fortnight thereafter. The learned trial court within the said fixture of fifteen days would be at liberty to fix as many dates but the learned Judicial Magistrate, 1st Court, Barasat, North 24-Parganas is directed to pronounce his order in respect of interim maintenance on or before 15th February, 2024.

With the aforesaid observations, CRR 2901 of 2023 is

disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
