By this writ petition, petitioner has challenged the impugned garnishee order dated 2nd August, 2022 being Annexure P/4 to the writ petition on the ground that the appeal against the adjudication order out of which the demand in question arises is pending before the Tribunal.

Considering the facts and circumstances of the case and view of the submission made by learned advocate appearing for the petitioner that it should be allowed to operate the bank account in question subject to retaining the amount of Rs. 23,92,835/- till the disposal of the pending appeal in question before the learned Tribunal.

It is expected that the learned Tribunal will dispose of the pending appeal in question expeditiously.

With this observation and direction this writ petition being WPA 19031 of 2022 is disposed of. (Md. Nizamuddin, J.)
