Learned counsel appearing for the petitioner as well as the respondent Bank submits on instructions that the petitioner has made a fresh application before the Bank for extension of the grant of credit facility under Extension 1.0 on 12th October, 2022.

After hearing learned counsel on this aspect, this court is of the view that since the petitioner is before the respondent Bank for the same relief, namely, grant of extension of the credit facility, the Bank should be given liberty to decide that issue once and for all. This court is not inclined to pass any orders or express its view on the impugned rejection dated 11th May, 2022 as that

could have a bearing on the decision of the respondent Bank.

W.P.A.18989 of 2022 is accordingly disposed of with a direction on the respondent Bank to dispose of the application, which was made on 12th October, 2022, by 7th February, 2023. The Bank shall not take any further time since the Scheme is effective till 31st March, 2023. The Bank shall hear an authorised representative of the petitioner before passing the reasoned order. The reasoned order shall be made available to the petitioner by 9th February, 2023. Needless to say, the petitioner's application will be disposed of in accordance with the Emergency Credit Line Guarantee Scheme.
