The petitioners are aggrieved by the acts of commission and/or omission of the respondent authorities, particularly the University, in not permitting the petitioners to obtain registration for the academic session 2024-26. 2.

Mr. Bose appearing for the petitioners has submitted that inspite of submission of all testimonials and credentials with the college authorities, the same were not duly submitted by the college authorities to the University. This resulted in the petitioners not being able to fill up the online form and thereby missing the opportunity of registration for the same semester.

Mr. Ray appears for the college authorities and makes his submission.

Mr. Baidya appearing for the University-respondent Nos.1 to 4 submits that the online registration has now been closed.

The petitioners, who are all students, cannot be made to suffer on account of technical glitches and/or errors which may have occurred on the part of the authorities concerned.

6. The petitioners have attended the classes regularly and have been diligently pursuing their B. Ed. programme. 7.

It would be grossly unjustified, if the petitioners were not permitted to obtain registration for the posts as it could impede not only the pursuit of their degree course but would also impinge their career prospects.

8. This issue has been considered in MAT 1115 of 2025 with CAN 1 of 2025 (Sanjoy College of Education & Anr. Vs. The Baba Saheb Ambedkar Education University & Ors.) by a Division Bench of this Hon'ble Court.

9. Having heard the respective parties, it appears that the students had applied through online mode for the B. Ed. course for the 2024-26 session and their names had appeared in the list generated by the University based on merit and performance for admission. On the basis of such enlistment, the petitioners had availed of admission in the said college and had also been attending classes and pursuing the post studies diligently since inception.

10. In view of the fact that the students have taken steps to pursue their courses and cannot be foisted with the laches

on the part of the college authorities and penalized, I direct the University to afford an opportunity of registration to the petitioners upon payment of a cost of Rs.20,000/- for each student to the University for registration. The University is directed to permit the students to take the supplementary examination consequential to the registration as and when the same is conducted by the University.

11. I make it clear that the costs awarded are not as a penalty or a punishment but merely to recompense this situation and circumstances, which have arisen in the matter.

12. This order is passed in the peculiar facts and circumstances of this case and will not be treated as a precedent.

13. With the aforestated direction, the writ petition is disposed of.

14. Since affidavits have not been called for, allegations contained in the petition are deemed to have been denied.

15. There shall be no order as to costs.

16. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Reetobroto Kumar Mitra, J.)
