Report dated 23.08.2023 submitted by Mr. Anwar Hossain, learned advocate appearing for the State. Learned advocate for the State has produced the case diary and I have perused the same. Since the investigation of the case is in progress, the details are not being discussed. However, this Court while exercising its power under Section 482 of the Code of Criminal Procedure is supposed to test regarding the issue whether a prima facie case is made out for the police to conclude their investigation at this stage. Having regard to the verbal allegations and the documents which have been collected against the petitioners, I am not inclined to interfere with the proceedings at this stage. The investigating agency be allowed to take the case to its logical conclusion by way of filing a report under Section 173 of the Code of Criminal Procedure.
The petitioners would be at liberty to approach this Court after the report under Section 173 of the Code of Criminal Procedure is filed and the documents under Section
207 of the Code of Criminal Procedure are supplied to the petitioners.
With the aforesaid observations, the revisional application being CRR 2903 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
