This revisional application under Section 401/482 of the Cr.P.C. has been listed today for hearing. There is no interim stay order relating to proceeding of the case challenged herein.

The petitioner prayed for quashing of proceedings in Complaint Case No. C-256 of 2010 under Sections 138/142 of the N.I. Act pending before the learned Judicial Magistrate, 2nd Court, Barrackpore. After admission of the revisional application, an interim order dated 10.10.2012 was passed staying the proceedings in the case for three weeks after Puja Vacation so far as the petitioner is concerned. The petitioner has not appeared today nor is he represented by any Advocate. Affidavit of service has not been filed.

The revisional application is, therefore, dismissed for default. The same is accordingly disposed of.

Let a copy of this order be sent to learned Judicial Magistrate, 2nd Court, Barrackpore for information.
