This revisional application under Sections 482 and 401 of the Cr.P.C. is listed today for hearing.

The petitioner has preferred this application praying for setting aside the order dated 7.7.2011 passed by the learned Judicial Magistrate, Mandi, Murshidabad in C.R. Case No. 208 of 2010. None appears for the petitioner. Mr. Binoy Panda along with Mr. Pratick Bose, learned advocates appear for the State. The appointments of the State advocates may be regularized by the concerned authority. On a perusal of the record, it appears that the petitioner has challenged the order whereby the learned Magistrate had dismissed the case under Section 203 of the Cr.P.C. after having considered the report submitted by police which did not disclose any offence. On the relevant date, the complainant had remained absent without steps. Since none appears for the petitioner, I have no reason to interfere with the order passed by the learned Magistrate.

The revisional application is dismissed for default. The same is accordingly disposed of.

Let a copy of this order be sent to learned Judicial Magistrate, Kandi, Murshidabad for information.
