On 20th January, 2021, the appellant was not represented. However, on 25th January, 2021 Mr. Dyutiman Banerjee, learned Advocate, appeared on behalf of the appellant and had prayed for an adjournment in order to enable him to receive necessary instruction from his client.

Mr. Banerjee, Advocate, is not present today. It appears that the appellant is not interested to proceed with the matter. Moreover, it appears that the order under challenge is dated 25th July, 2019 rejecting the application under Order XXXIX Rules 1 and 2. The appeal seems to have spent its force.
