Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of statement of co-accused. It has also been submitted that one of the accused person is absconding and there is no possibility of the trial commencing in close proximity of time. As such he may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that one of the accused is absconding. It has been also submitted that there are 4 antecedents of the petitioner in connection with NDPS Cases.

I find from the records of the case that 3 of the accused persons are before the Court while one of the accused person is absconding.

Accordingly, learned Trial Court is directed to exhaust the process of law and split up the trial of the Case. Petitioner be released on bail after the stage of consideration of charges are over on such terms and conditions as the learned Special Court deems fit and proper for ensuring the appearance of the accused.

With the aforesaid observations CRM (NDPS) 1012 of 2025 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
