Earlier, none appeared on behalf of the petitioner. Mr. Aniket Mitra, Learned Advocate, appeared on behalf of the State.

Today, when the matter has been called, also none appeared on behalf of the petitioner.

On perusal of the charge-sheet, I find that Section 188 of the IPC has been incorporated and the same is required to be invoked by a person whose order has been violated.

Accordingly, the said section be dropped from the charge-sheet. So far as the other sections in the Penal Code and the Disaster Management Act, are concerned, the Learned Trial Court would proceed in accordance with the law.

With the aforesaid observations, CRR 3086 of 2022 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
