The writ petition is disposed of with a direction upon the Under Secretary to the Government of India, Freedom Fighters' Division, New Delhi to dispose of the representation of the petitioner which is at page 117 of the writ petition, within a period of two months from date.

The issues to be decided are whether the pension should be paid to the wife of the deceased freedom fighter under the Swatantrata Sainik Samman Pension Scheme, 1980, from the next date of death of the freedom fighter and the whether the widow would be entitled to interest on such arrear. The points raised by the petitioner seems to be legitimate and if the authority finds the prayers to be in accordance with the provisions of the scheme and the laws laid down, further order shall be passed releasing such payment.

There shall be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
