1. The grievance of the petitioners is directed against non-consideration of a representation dated 9th July, 2025 issued to the concerned Municipality being the respondent nos. 2, 3 and 4. A prior representation had also been made on 11th August, 2025.

2. The petitioner is a reputed school, i.e. Calcutta Boys' School situated at Mouza- Sonarpur, Khatian NO. 280/281, Dag Nos. 456/457/458, Holding No. 80, Purba Baidyapara, Ward No. 12 now re-numbered as Ward No.13, under Sonarpur Police Station within the limits of the Rajpur Sonarpur Municipality, South 24 Parganas.

3. It is alleged on behalf of the petitioners that there is an attempt to illegally and fraudulently encroach on a pond located within the premises of the school. The

petitioners also complain of unauthorized deposit of taxes by the private respondents and consequential mutation in their name. There are serious allegations of public safety insofar as overflowing of the water body at the suit premises.

4. Despite numerous requests the statutory respondents have failed to consider or dispose of the representations filed by the petitioners.

5. In view of the above, WPA 18415 of 2025 stands disposed of by directing the Chairman being the respondent No.2 to consider and dispose of the representation of the petitioners dated 9th July, 2025 and 11th August, 2025 within a period of four weeks from the date of communication of this order and after giving a right of hearing to all the affected parties including the private respondent.

6. It is made clear that there has been no expression in so far as the merits of the case are concerned and all questions are left open to be decided strictly in accordance with law.

7. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
