Learned counsel for the petitioner, with leave of court, files supplementary affidavit which is kept on record.

It is evident from the supplementary affidavit and its annexure that a certificate of registration of existing well was granted long back to the petitioner by the appropriate authorities.

Learned counsel for the WBSEDCL submits that although initially the Distribution Licensee had taken an objection that the said certificate was missing from the application, in view of production of the application by the petitioner, there is no further impediment to give electricity connection to the petitioner, subject to compliance of other formalities.

Although it is contended by learned counsel for the WBSEDCL that the certificate-in-question is required to be handed over to the WBSEDCL by the petitioner, since such certificate is already a part of the supplementary affidavit filed today, the WBSEDCL is directed to treat the same as a part of the application of the petitioner for new connection and process the application of the petitioner immediately.

Since a quotation has already been raised by the WBSEDCL in that regard, which apparently could not have been possible without the production of such certificate at the inception, it is deemed that the certificate was produced in due time by the petitioner. Hence, WPA 19032 of 2022 is disposed of by directing the WBSEDCL to give electricity connection to the petitioner as expeditiously as possible, positively within a fortnight from date.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
