Petitioner is directed to serve a copy of the revisional application upon Mr. Begg, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities. Learned advocate for the petitioner submits that the petitioner initiated the instant case being Rajarhat PS Case No.334 of 2020 under Sections 420/406/506/34 of IPC. The grievance of the petitioner is that he filed an application under Section 173(8) of Cr.P.C. before the learned Magistrate on 5th December, 2022. The same is pending and finally learned trial court has fixed date i.e. 6th November, 2023 for hearing of such application and for further investigation.

Having regard to the grievance expressed by the present petitioner, I direct the learned Chief Judicial Magistrate, Barasat to conclude the hearing of the application under Section 173(8)/protest petition/naraji

petition on 6th November, 2023 and/or within a month thereafter.

Learned Chief Judicial Magistrate, Barasat would pronounce his order/verdict in respect of the application for further investigation by 15th December, 2023. With the aforesaid observations, CRR 2907 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of all requisite formalities.
