CRR 3215 of 2024 In Re: Abir Maiti Mr. Rajdeep Majumder Mr. Mayukh Mukherjee Mr. Sagnik Banerjee Ms. Aishwarya Bazaz .... For the Petitioner Heard learned counsel for the petitioner.

It appears that by an order passed on 26th April, 2024 in CRR 1362 of 2024 this Court observed as follows:- "If the learned Magistrate on perusal of the records finds that the petitioner was earlier on bail he will allow the petitioner to continue on the same bail, however a fresh bond must be furnished by way of a local surety which would be the title deed of a property within the jurisdiction of the learned ACJM, Haldia.

Pursuant to the surrender of the present petitioner, the learned could would recall the proclamation and warrant of arrest, which was earlier issued.

This order will remain in force till 4th May, 2024. If the petitioner do not appear or surrender in that case the learned trial court/ Magistrate would revive his earlier order relating to attachment of the property on the next working day." Learned counsel for the petitioner submits that the petitioner was not able to surrender before the learned trial Court within the stipulated time frame due to Parliament elections since he was the booth president for the party in opposition. Learned counsel further submits that the order of this Court was not communicated to the learned trial Court for

which the learned Court has been fixing dates for attachment report. The petitioner undertakes to surrender before the learned trial Court within 7 days from date.

If the petitioner surrenders before the learned trial Court within 7 days from date, the learned Court shall accept his surrender in terms of the direction laid down in the order dated 26th April, 2024 in CRR 1362 of 2024. In the event the petitioner fails to surrender before the learned trial Court within the stipulated time frame, learned trial Court shall be at liberty to take necessary steps against the petitioner, in accordance with law without further reference to this Court. The revisional application being CRR 3215 of 2024 is disposed of. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
