Mr. Usof Ali Dewan Mr. Asif Dewan ..for the petitioner Mr. Lalit Mohan Mahata Mr. Prasanta Behari Mahata ..for the State Mr. Sarwar Jahan Mr. Amit Bikram Mahata ..for the respondent no.4 It is the grievance of the petitioner that the respondent no.6 floated a tender for executing certain works as mentioned in the Annexure A to the tender notice.

It is the grievance of the petitioner that the panchayat authority wrongfully rejected his technical bid. The petitioner seeks to participate in the tender process.

Learned advocate for the respondent no.4 on the other hand submits that the petitioner's technical bid was rejected since he could not produce the relevant document in terms of Clause 8 of the tender notice. The allegation of the respondent no.4 is

substantiated from the admission of the petitioner as apparent from the letter dated July 26, 2024, written by the petitioner to the authorities. In the said letter the petitioner has clearly admitted that he did not submit the work schedule in terms of Clause 8 of the tender notice.

In that view of the matter, I do not find any reason to interfere with the decision of the panchayat to reject the tender of the petitioner. This writ petition is devoid of merit and accordingly WPA 19242 of 2024 is dismissed.

Let a report filed by the State is kept with the record.
