Kausik (Allowed) CRM (NDPS) 1014 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Asansol (North) Police Station Case No. 125 of 2025 dated 30.03.2025 under sections 21(b)/25/29 of the NDPS Act, 1985;

Learned advocate appearing for the petitioner submits that the subject matter of the case relate to 51.14 Gms. of Heroin being recovered. There are three accused persons in the present case. Two of the accused persons have been granted bail.

Learned advocate further submits that there is no possibility of the trial concluding very soon, as such the petitioner may be released on bail on any stringent condition. Learned advocate for the State opposes the prayer for bail and submits that the grounds on which the other accused persons were granted bail are completely different from the locus of the present petitioner.

Already charges have been added under the organized crime offences. It has also been submitted that there are antecedents of the petitioner.

It has been pointed out that charges have already been framed in connection with the instant case.

Accordingly, the petitioner be released on bail. Accordingly, petitioner, namely, Gopi Singh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of learned Special Court under NDPS Act cum Additional Sessions Judge, 3rd Court, Asansol.

If on bail the petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the district of Paschim Bardhaman without the permission of the Special Court. Additionally, petitioner would meet with the Officer-in-Charge/Inspector-in-Charge of Asansol (North) Police Station once in a week until and unless the same condition is modified by the learned Special Court. With the aforesaid observations CRM (NDPS) 1014 of 2025 is allowed.
