1. Affidavit of service as well as written instruction dated 02.03.2026 filed in Court and the same be taken on record.

2. At the time of hearing, learned counsel appearing on behalf of the appellant submits before this Court that he has received written instruction from his client not to proceed with the instant appeal any further.

3. In view of the submission made on behalf of the appellant, M.A.T. 1349 of 2025 stands dismissed as non-prosecution.

4. With the dismissal of the instant appeal, pending interlocutory application being, I.A. No. CAN 1 of 2025 is also dismissed for nonprosecution.

5. Interim order, if there be any, stands hereby vacated.

6. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
