The petitioner has challenged the order passed by the learned Additional Chief Judicial Magistrate, Haldia on 6th March, 2023 directing issuance of warrant of proclamation and attachment against the petitioner in G.R. case no. 971 of 2007. It appears that the petitioner was granted anticipatory bail by an order of the Hon'ble Division Bench on 1st April, 2010 in CRM 4443 of 2010. Warrant of arrest was issued against the petitioner on 4th February, 2019 since the petitioner was found absent on that date before the learned Magistrate. Warrant of proclamation and attachment has been issued against him vide order passed on 6th March, 2023. The petitioner undertakes to surrender before the learned Magistrate within seven days from date.

If the petitioner surrenders before the learned Magistrate within the said date, learned Magistrate shall allow him to remain on the same bail upon furnishing a fresh bond by way of local surety having title deed in respect of a property within the jurisdiction of the learned Additional Chief Judicial Magistrate, Haldia.

take necessary steps in accordance with law without further reference to this Court.

Warrant of proclamation and attachment issued against the petitioner be stayed till 18th October, 2024. CRR 3224 of 2024 is disposed of.
