Heard learned counsels for the parties.

The petitioner's grievance is that an application made by him for issuance of permit in respect of the contract carriage owned by him was not accepted or considered by the authority.

Such allegation of the petitioner is denied by the respondents.

Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that since the petitioner intends to apply for issuance of permit before the authority, the authority be directed to accept the said application and consider the same in accordance with law.

In view of the above, the writ petition is disposed of with liberty to the petitioner to submit the application as prayed for before the 2nd respondent within seven days from date. The 2nd respondent is directed to consider the

said application within six weeks from the date of receipt thereof upon granting an opportunity of hearing to all the interested parties, including the petitioner, in accordance with law upon the petitioner depositing the requisite fees for the same.

The decision taken by the authority shall be communicated to the petitioners within a week thereof. With the above observations the writ petition being WPA 17598 of 2019 is disposed of.

However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
