Despite service, none appears on behalf of the respondents.

The petitioner has constructed a multistoreyed building. The respondent no. 5 was appointed as his constituted attorney. The allegation is that the respondent no. 5 did not perform the duties as per the power of attorney and cheated the petitioner.

This court finds that the dispute arose out of a commercial/contractual transaction between the parties.

It is submitted by Mr. Lahiri, learned advocate appearing on behalf of the petitioner, that an FIR has been registered.

The Officer-in-Charge, Pandua Police Station shall act and proceed in accordance with law on the basis of the complaint lodged by the petitioner.

The writ petition is disposed of.

There shall be no order as to costs.
