The report submitted by Mr. Banerjee, learned advocate appearing for the State be kept with the record. Report reflects that P.W.20 Taijuddin Ahammed can be produced for cross-examination before the learned trial court on 19th February, 2022. The certified copy so submitted by the petitioners reflect that the next date is fixed on 19th February, 2022 for further cross-examination of P.W.21.
The learned trial court is directed that after the crossexamination of P.W.21 is completed on 19th February, 2022, an opportunity for cross-examination should be given to the petitioners for cross-examination of P.W.20. The cross-examination of both the witnesses must be completed by 22nd February, 2022. The learned court would thereafter proceed for examination under Section 313 of the Code of Criminal Procedure on a convenient date which the
learned trial court deems fit and proper. All efforts must be taken by the concerned Officer-in-Charge for production of P.W.20 on 19th February, 2022 (as has been submitted in the report) before the learned trial court With the aforesaid observations, CRR 2680 of 2018 is disposed of.
Pending application, if any, is consequently disposed of. Learned Registrar (Judicial Service), High Court, Calcutta is directed to communicate this order to the learned trial court by 17th February, 2022.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copies of this order, if applied for, be given to the learned advocate for the parties, upon compliance of all requisite formalities.
