(VIA VIDEO CONFERENCE) Mr. Biswajit Sarkar Mr. Arindam Das ...for the petitioner Mr. Amitesh Banerjee Mr. Tarak Karan ...for the State The grievance of the petitioners pertains to allotment of a particular plot of land which has been granted to the petitioner by the State respondents.

Mr. Sarkar, Advocate appearing on behalf of the petitioner relies on a notice dated July 31, 2019 to contend that the process of demarcation has already begun and the police along with necessary team of Amin have been appointed by the Block Land and Land Reforms Officer, Kandi, Murshidabad.

Mr. Banerjee, Advocate appearing on behalf of the State respondents submits that there is no dispute in respect of the plot of land which has been allotted to the petitioner. The private respondents have been allotted a distinct plot of land which in no way overlaps with the land of the petitioner.

However, since the process of demarcation has already begun in terms of the order dated July 31, 2019

being Annexure P/3, WPA No. 17613 of 2019 is disposed of by directing that the steps taken in terms of the communication dated July 31, 2019 by the Block Land and Land Reforms Officer, Kandi, Murshidabad be taken to the logical conclusion and the process for demarcation be completed if not already completed.

It is made clear that nothing should be construed as being an adjudication on the merits of the case in so far as the grievance of the petitioners are concerned and the concerned Officers are directed to act in accordance with law.

With the above observations and directions WPA No. 17613 of 2019 is disposed of.

There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
